General Terms and Conditions

RE Driver Development (REDD)

1. Definitions

In these General Terms and Conditions:

RE Driver Development / REDD refers to the driver coaching and development services operated by Bram Ossewaarde.

Coach refers to REDD or any representative acting on behalf of REDD.

Client refers to the individual or legal entity purchasing services from REDD.

Driver refers to the person receiving coaching services.

Services include, but are not limited to, online coaching sessions, data analysis, video analysis, consultations, and coaching packages.

Session refers to a scheduled online coaching appointment.

2. Applicability

These Terms and Conditions apply to all services, offers, agreements, bookings, and invoices issued by REDD, unless explicitly agreed otherwise in writing.

By purchasing, booking, or using any REDD service, the Client confirms acceptance of these Terms and Conditions.

3. Services

REDD provides online driver coaching and performance-related educational services.

All services are delivered on a best-effort basis. REDD does not guarantee specific results, including but not limited to lap times, rankings, championships, race results, or career progression.

Coaching is advisory and educational in nature. The Client and/or Driver remains fully responsible for all decisions and actions taken based on the coaching provided.

4. Payment Terms

All services are paid in advance via invoice.

An invoice must be paid in full before the scheduled session takes place.

Unpaid invoice = no session.

REDD reserves the right to cancel or suspend services if payment is not received by the agreed deadline.

5. Scheduling, Cancellation & Rescheduling

5.1 Client-Initiated Changes

Sessions can be cancelled or rescheduled free of charge up to 24 hours before the scheduled start time.

A new session will be scheduled in mutual agreement.

5.2 Coach-Initiated Changes

REDD reserves the right to reschedule a session at any time, in consultation with the Client.

A suitable alternative time will be proposed.

6. No-Show Policy

If the Client or Driver does not attend the session without prior notice, this is considered a no-show.

The Coach will wait a maximum of 15 minutes after the scheduled start time.

After 15 minutes, the session is considered cancelled.

In case of a no-show:

The session is forfeited

No refunds are possible

It is not possible to reschedule the session

7. Refund Policy

7.1 Single Sessions

Refunds are not available once a session has taken place or in the event of a no-show.

7.2 Multiple-Session Purchases

When purchasing one or more sessions as a package:

Cancellation is possible up to 24 hours before the scheduled session

The Client is entitled to a 50% refund of the total purchase amount

Refunds will be processed using the original payment method within a reasonable timeframe

8. Right of Withdrawal (EU Consumer Law)

By purchasing and scheduling a session, the Client explicitly agrees to the immediate performance of the service and waives the statutory 14-day right of withdrawal, insofar as permitted under applicable consumer law.

9. Client Responsibilities

The Client and/or Driver is responsible for:

Providing accurate and relevant information

Ensuring a stable internet connection for online sessions

Being on time for scheduled sessions

Using coaching advice responsibly and at their own risk

10. Minors (Under 18 Years of Age)

If the Driver is under the age of 18, all contractual, financial, and administrative matters shall be handled exclusively with the parent(s) or legal guardian(s).

The parent(s) or legal guardian(s) are considered the Client for all legal, financial, and liability purposes.

The parent(s) or legal guardian(s) are fully responsible for:

Payment of all invoices

Compliance with these Terms and Conditions

Communication with RE Driver Development (REDD)

REDD strongly recommends that a parent or legal guardian is present during coaching sessions if the Driver is 13 years of age or younger.

If a parent or legal guardian chooses not to attend such a session, this is done at their own discretion and responsibility.

REDD reserves the right to require parental presence, reschedule, or refuse to conduct a session if this is deemed necessary for the Driver’s well-being, communication clarity, or proper execution of the session.

11. Intellectual Property

All materials, explanations, analyses, methods, documents, and content provided by REDD remain the intellectual property of REDD, unless explicitly agreed otherwise in writing.

It is not permitted to:

Record sessions without prior written consent

Share, copy, resell, or distribute materials

Use REDD content for commercial purposes

12. Limitation of Liability

REDD is not liable for:

Direct or indirect damages

Loss of income, results, or opportunities

Decisions made by the Client or Driver based on coaching advice

The total liability of REDD is limited to the amount paid for the specific service concerned.

13. Force Majeure

REDD is not liable for failure or delay in performance due to circumstances beyond reasonable control, including but not limited to illness, technical issues, internet failures, or force majeure events.

14. Privacy & Data Protection

REDD processes personal data in accordance with applicable data protection laws, including GDPR. Personal data is used solely for service delivery and administrative purposes and will not be shared with third parties unless legally required.

15. Governing Law & Jurisdiction

These Terms and Conditions are governed by Dutch law.

Any disputes shall be submitted exclusively to the competent court in the Netherlands, unless mandatory law dictates otherwise.

16. Final Provisions

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain fully valid.

REDD reserves the right to amend these Terms and Conditions at any time.

The most recent version published on the website applies.

17. In-Real-Life (IRL) / On-Track Coaching

17.1 Nature of IRL Services
In-Real-Life (IRL) coaching includes, but is not limited to, on-track coaching, circuit-side guidance, driver instruction, performance analysis, technical advice, setup support, and/or mechanic services during test days, training sessions, or race events.

All IRL services are instructional, advisory, and supportive in nature and do not constitute a guarantee of safety, performance, results, or mechanical reliability.

17.2 Inherent Risks & Assumption of Risk
Motorsport and karting are inherently dangerous activities and involve significant risks, including but not limited to:

Crashes and collisions

Mechanical failures

Property damage

Serious injury or death

By participating in IRL services, the Client and/or Driver explicitly acknowledges and accepts these risks and participates entirely at their own risk.

17.3 Exclusion of Liability for Damage or Injury
RE Driver Development (REDD) shall not be liable for:

Crashes or on-track incidents

Damage to karts, engines, vehicles, parts, equipment, or tools

Personal injury, bodily harm, or health-related issues

Indirect damage, consequential loss, or financial loss

arising before, during, or after IRL coaching, technical assistance, or mechanic services, regardless of cause.

17.4 Decision Authority
All driving, setup, technical, and operational decisions remain solely the responsibility of the Client and/or Driver.
Advice provided by REDD is non-binding and does not replace the Client’s own judgment.

17.5 Insurance Responsibility
The Client and/or Driver is solely responsible for holding:

Valid accident insurance

Liability insurance

Required racing licenses and/or circuit insurance

REDD has no obligation to arrange insurance coverage on behalf of the Client or Driver.

18. Technical Work & Mechanic Services

18.1 Best-Effort Obligation
All technical work, including assembly, inspection, setup, repair, or maintenance, is performed based on experience and knowledge and on a best-effort basis only.

REDD provides no guarantees regarding:

Mechanical reliability

Durability or lifespan of parts

Performance improvements

18.2 No Liability for Technical Consequences
REDD is not liable for failures, defects, or damage occurring after technical work has been performed, including but not limited to:

Engine damage

Drivetrain failures

Electrical or electronic malfunctions

19. Sale of New Parts – Dropshipment

19.1 Dropshipment Structure
When purchasing new parts through REDD, products are shipped directly from the supplier or importer to the Client (dropshipment).

19.2 Supplier Terms & Delivery Conditions
The delivery, shipping, and warranty conditions of the supplier or importer apply to the shipment.

REDD acts as an intermediary and does not physically handle the product prior to delivery unless explicitly stated otherwise.

19.3 Damaged or Missing Deliveries
If a product:

Does not arrive, or

Arrives damaged

the Client shall notify REDD without delay.

REDD will arrange for a replacement product to be supplied.
The original invoice remains valid and payable.

The defective or incorrect product must be returned either:

To REDD, or

Directly to the supplier,
as instructed by REDD.

20. Sale of Used / Second-Hand Products

20.1 Condition of Used Products
Second-hand products sold by REDD are supplied directly by REDD and are:

Inspected

Prepared for use

Repaired where necessary

to the best of REDD’s professional knowledge at the time of sale.

20.2 Engines & Third-Party Sealing / Revision
Where applicable, engines may be sealed and/or revised by third-party specialists, such as JVD Power.

REDD does not provide any additional guarantees beyond:

The factual condition at the moment of delivery

Any explicit written agreement

Any responsibility related to sealing, homologation, or compliance lies with the issuing third party.

20.3 Exclusion of Warranty on Used Products
Used products are sold “as is”, to the maximum extent permitted by Dutch law.

REDD excludes all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or future performance.

21. Limitation of Liability (IRL & Products)

To the maximum extent permitted by law, the total liability of RE Driver Development (REDD), arising from IRL coaching, technical services, or product sales, is limited to the amount paid by the Client for the specific service or product concerned.

22. Arrive & Drive Services

22.1 Nature and Purpose of Arrive & Drive
Arrive & Drive services include the provision of a kart, engine, equipment, basic technical support, and operational guidance by RE Driver Development (REDD) for participation in test days, training sessions, or events.

Arrive & Drive participation is intended as a serious step toward competitive, real-world karting and is not designed for beginners or first-time drivers.

Arrive & Drive participation is offered as a temporary participation service and does not constitute a rental, lease, or hire agreement under civil law.

22.2 Eligibility, Experience Level & Acceptance
The Client and/or Driver acknowledges that Arrive & Drive participation requires a sufficient level of karting experience, driving skill, racecraft, and track awareness to ensure safety for all participants.

RE Driver Development (REDD) reserves the unrestricted right, at its sole discretion, to:

Assess the experience and competence level of the Client and/or Driver

Request prior karting history or supporting information

Accept or refuse an Arrive & Drive application

Terminate participation before or during the event if the experience level is deemed insufficient

Refusal or termination based on experience level or safety concerns does not entitle the Client to any right of participation.
Refunds in such cases are at the sole discretion of REDD.

22.3 Advance Payment Requirement
All Arrive & Drive services must be paid in full in advance.

No payment = no participation.
REDD reserves the right to deny access to the track or terminate participation if payment has not been received in full prior to the event.

22.4 Driver Conduct & Responsibility
The Client and/or Driver is fully responsible for their conduct on track, including but not limited to:

Driving behavior

Compliance with circuit rules and regulations

Respect for flags, officials, and safety instructions

Any damage occurring on track shall be financially borne by the Client, even if the incident or damage is not directly caused by the Client or Driver.

22.5 Instructions & Authority of REDD
All instructions issued by REDD regarding driving behavior, safety, mechanical limitations, session management, or operational conduct are binding and must be followed without exception.

Failure to comply with instructions grants REDD the unilateral right to immediately:

Terminate Arrive & Drive participation

Deny further access to the track

Such termination does not entitle the Client to any refund or compensation.

22.6 Damage Liability & Post-Calculation Settlement
All damage to karts, engines, parts, tires, and equipment occurring during Arrive & Drive participation shall be:

Assessed after the event

Invoiced on a post-calculation basis

All assessed damage costs are payable by the Client.

22.7 Exception: Mechanical Failure Not Caused by Driver Behavior
Damage resulting exclusively from mechanical failure that is:

Not caused by Driver behavior, misuse, over-revving, negligence, or non-compliance with instructions, and

Technically verifiable

shall be borne by REDD.

The technical assessment and final determination regarding cause of damage rests solely with REDD.

22.8 Mandatory Damage Insurance
The Client is required to purchase a mandatory damage insurance fee of EUR 500 (excluding VAT).

This insurance covers damage costs up to a maximum of EUR 1,500 (excluding VAT) per Arrive & Drive event.

Any damage exceeding this amount shall be fully charged to the Client.

This insurance does not cover:

Personal injury

Total loss

Damage caused by gross negligence or intentional misconduct

Damage resulting from failure to follow instructions

22.9 Pre-Event Information Obligation
The Client must provide accurate and complete information prior to the event, including but not limited to:

Height

Weight

Seat size

Relevant driving experience

If incorrect or incomplete information results in required adjustments on site, any time spent making such adjustments shall be deducted from the Client’s track time.

REDD is not liable for any loss of track time resulting from incorrect information provided by the Client.

22.10 No Guarantee of Track Time
Track time is subject to external factors beyond REDD’s control, including but not limited to:

Weather conditions

Red flags or on-track incidents

Circuit scheduling decisions

Technical issues

REDD provides no guarantee of minimum track time.

22.11 Termination Without Liability
REDD reserves the right to terminate Arrive & Drive participation at any time if, in REDD’s sole discretion:

Safety is compromised

Instructions are not followed

Driver competence is insufficient

Behavior is deemed irresponsible or unsafe

Such termination shall not result in any refund, compensation, or liability for REDD.
